Information Regarding Variances Issued in 2024 from Providing Fire Inspection Documentation

Variances issued in 2024 to migrant labor camps from the requirement to provide documentation from the local fire department/inspector that the facilities at the migrant labor camp meet the state and local fire codes expire on December 31, 2024.

Applications for variances from this requirement in 2025 will require additional information and documentation.

Camp operators will need to complete the DETM-5942-E: Petition for Variance Application

Operators of migrant labor camps located in facilities already classified as a commercial building, such as apartment complexes or condo associations that received an annual inspection, must:

Send the fire department/inspector the DETM-19725-E Local and State Fire Code Compliance Documentation for a Migrant Labor Camp to complete, and
Submit the completed DETM-19725-E Local and State Fire Code Compliance Documentation for a Migrant Labor Camp with the variance application.

Operators of migrant labor camps that are currently classified as a private residence will need to submit documentation with their variance request regarding the steps they have taken to have their migrant labor camp properly classified. Examples include but are not limited to:

Information regarding submitting Change of Use plans through Plan Review.
Steps taken with fire department/inspector to assist in ensuring the facilities are appropriately classified.
Communication with a local municipality or delegated municipality to determine if the migrant labor camp's facilities are appropriately classified.
Communication with local or state Building Inspector to determine if the migrant labor camp's facilities are appropriately classified so a fire inspection can be conducted.

The Department of Safety and Professional Services (DSPS) is also reminding local fire inspectors of the annual requirement to inspect migrant labor camps and asking them to provide assistance with navigating the Change of Use process with DSPS.
